Minnesota Booking Photo Law
Minnesota law gives booking photographs a direct public-record rule. Minn. Stat. § 13.82, subd. 26 defines a booking photograph as a photograph or electronically produced image taken by law enforcement for identification in connection with an arrest. Except as otherwise provided, the booking photograph is public data. The same subdivision lets a law enforcement agency temporarily withhold access when the agency determines release would adversely affect an active investigation.
Related provisions fill in the limits. Section 13.82, subdivision 2 makes certain adult arrest data public at all times, including data documenting arrest, incarceration, custody location, legal basis, release or transfer details, and listed identifying data. Minn. Stat. § 13.03 supplies the general inspection and copy process for public government data, including fee limits. Minn. Stat. § 13.85 protects corrections and detention data when disclosure would reveal protected personal information, endanger life or institutional security, identify a confidential informant, or harm an investigation.
Booking photo statute: Minn. Stat. § 13.82, subd. 26 treats booking photographs as public data unless another rule applies. Active-investigation withholding can be temporary, and protected detention data can still be private or confidential under related statutes.

The statute image supports the public-record discussion, but the text of the law still has to be applied by the agency holding the data.
Marshall County Photo Limits
A public booking photograph is not the same as a public release of every jail, medical, security, or case file detail. The roster can show enough to identify the current custody event, while other facts may be withheld, unavailable online, or held in a different system. Marshall County's own roster notice says the information is generally updated in the morning and should not be used as the sole basis for legal action.
What is and is not public: A booking photo and adult arrest data may be public under Minnesota law. The Pennington County Sheriff's Office source states that Pennington County holds all female Marshall County inmates because Marshall County can hold female inmates only briefly. It also notes that Marshall County can hold male inmates for up to 90 days under the restriction described there.

State and Federal Photo Limits
